Terms And Conditions

Purpose:
To summarize our agreement to you and what we expect for payment and other terms from you.  The intent of this information is to make sure we’re completely clear and there is no miscommunication.  If you have any concerns or questions please contact us.  We want this to be a smooth and successful transaction so we can build a strong working relationship.  We want you to be as successful as possible while using Quebert Email Marketing Services.  Payment for subscription or one-time services constitutes agreement with the following terms and conditions.

 

Service Summary:

Quebert is an email marketing service that you can use to create autoresponders and email campaigns; sent to your list of customers and prospects.  We’ll provide you with an account, password, and access to Quebert. You upload your customer list, create the autoresponders and email campaigns and use the service as much as you’d like during the terms of service.  We’ll also provide you with a free dialog box/web form that you can easily add to any existing website, so prospects or existing customers can add themselves to your list for newsletters, product announcements, etc… You are not buying any software and do not own any rights to Quebert.  You are paying for a subscription to a service that will terminate once you stop paying for it or violate any of these terms and conditions. (We provide up to 1.5 hours of integraion, customization support for all subscription packages.  Above this mark, we consider this time billable as level 2 support. - see "Support Limitations" below for specifics.)

 

Service Limitations and Options:

Our service tiers are as follows:
0-3500 emails sent per month: $9.95 per month* or $99.95 per year.  Unlimited Lists.
0-10,000 emails sent per month: $19.95 per month* or $199.95 per year.  Unlimited Lists.
0-25,000 emails sent per month: $49.95 per month* or $499.95 per year.  Unlimited Lists.
0-75,000 emails sent per month: $74.95 per month* or $799.95 per year.  Unlimited Lists.
0-150,000 emails sent per month: $99.95 per month* or $999.95 per year.  Unlimited Lists.
150,000+ please contact us for special pricing.
(*assumes that you are paying monthly for a 12 month minimum period of time) 

Campaigns will be sent through our SMTP server at a variable rate.  This rate will change based on the number of campaigns that are being sent out at the time you schedule your campaign.  Since our capacity to send has an upper limit, Quebert makes no guarantees that your list will be sent at a specific rate or speed.  It could take 24-36 hours for your list to completely send.  This depends on the size of your list and the number of campaigns using the server at the same time.  If you feel your list is sending too slow or there may be a technical issue, please contact us right away.  We can view all concurrent campaigns and determine if there is, infact, a problem.  Larger accounts sending 150,000 emails on a regular basis may request their own SMTP server account.  There is an additional charge for this, but we'd be happy to accomodate you and discuss the options. 

Support Limitations:
Level 2 paid support above your free 1.5 hours of customization support is a billable service.  To read more, click here.
Technical support to work through error messags is offered at no additional charge.

Account Usage:

This service is limited to one account per customer/business entity.  We will not allow a customer to purchase an account and send emails on behalf of another company/business entity.  Each business will need its own account.  If you need more than one account, please contact us and we’d be happy to set you up with an additional account.  We reserve the right to terminate your account at any time if we observe you using it for more than one company/business entity.

We reserve the right to terminate your account if you send a campaign that receives more than a 10% bounce rate.  In otherwords, if you send 1000 emails and more than 100 of them bounce, we will send you a warning.  If you do this a second time, you will be terminated.  We expect that you will verify each list for accuracy before using Quebert.  Having a high bounce rate, places us at risk of being black listed.  We appreciate your cooperation.  If you have any questions about this please write to us and ask for more specifics.  We can also recommend an email verification program if you need one. 

We also reserve the right to terminate your account if you are sending pornographic or SPAM with the Quebert Email Marketer Service.  We pride ourselves on being a clean, spam-free service.  We have a zero tolerance policy when it comes to these two items.  SPAM is defined as any information that is illegal, unlawful, or unwanted.  If you are reported as SPAMMING customers we will investigate.   You will be notified if this happens so we can hear both sides of the situation.  We will also, fully, cooperate with the police or FBI if an incident occurs.  There is no privacy when performing illegal acts.

The use of mass-email lists is not prohibited, but discouraged as this may end up placing our full service at risk of being black-listed due to SPAM.  If you do purchase a mass-email list, please make sure it is a certified 'double opt-in' list and the emails are requesting information specific to your industry.  If you get a list and it has hundreds or thousands of duplicates and bad emails, if you send your list and hundreds and thousands of them bounce, then it is not a double opt-in list and should be removed and not used on our service.  Our goal is to provide a high-quality service for "YOUR" customers and potential prospective customers - people subscribed through your website or in-store sign up sheet.  Purchasing a list is risky and may not produce the reputation or results you anticipate.  Thank you for your consideration and cooperation with regard to this topic and inclusion for our terms and conditions.

 

User Accounts:

Please keep your account id and password safe.  If someone accesses your account or an old employee uses it for malicious purposes we have no way of stopping them.  We’d suggest changing your password each month and only giving it out to people that you can trust.  Once they are logged in, they have complete access to your data.  Separate user accounts can be created with limited rights so please contact us if you need more than one user id.

 

Account Billing:

Monthly ($9.95):

Paid monthly via PayPal, MC, Visa, Discover, or company check.
Commitment is for 12 months.
 

Annually ($99.95, 199.95, 499.95, 799.95, 999.95):

Paid annually via PayPal, MC, Visa, Discover, or company check.

 

One time campaign of 10,000 emails or less ($49.95):

Paid before the campaign is sent. This is a one time, one campaign arrangement.  We upload your customers list, schedule the campaign, and provide you with the results, metrics.

 

Custom Template Design ($49.95):

Paid once the template is complete and placed into your account.  You can use this template over and over again, unlimited.  You also own the rights to this template if you’d like to take it and use in other systems or other places.  This is a one time fee.

 

Custom Template Design combined with the Basic Annual Service ($199.95):

Paid once a year and includes a custom designed template.  See above for custom template an annual service / basic teir descriptions.

If your monthly or annual subscription fee is late, a service charge of $15 will be added every 10 days it is not paid.  You’ll receive an initial 10 days grace period for monthly or annual payments, but will be charged a late service charge beyond the grace period. 

 

Total Cost of Ownership:

No Setup Fees. 

Pay based on your monthly expected volume - tiers. 

No additional or hidden charges. 

 

Agreement Termination:

If we decide to terminate our agreement because you have late or unpaid subscription fees 3 months in a row, your account login will be deactivated and legal action may be pursued to collect unpaid balances in addition to any labor or attorney fees.  Please take the time to communicate with us if you plan to be late or are having trouble meeting your monthly subscription fee commitment.  We’d much rather have the opportunity to work with you and figure out a solution, than pursue legal action.  Reinstating your account after you’ve been terminated will cost $25, so it’s important for us to talk before this happens. 

 

If you decide to terminate our agreement before the monthly or annual renewal date then you’ll lose any prepaid money.  We will not refund the remaining days or months of your prepaid account.  If you have a monthly subscription, we will give you 24-hours access to retrieve any lists or customer data that you’d like to take with you, or until the end of your month.  If you have an annual account, it will remain active until the end of your contract. 

 

As a courtesy, please notify us in either case if you do not plan to renew.
